SC Stays CCI's Penalty Of 200 Crore On Amazon

Bench of Justices Dinesh Maheshwari and Sanjay Kumar directed that no forceful actions should be taken against Amazon

The Supreme Court granted temporary relief to Amazon.com NV Investment Holdings LLC, a large e-commerce company, on May 8 by staying the penalty of Rs. 200 crore imposed by the Competition Commission of India in the Future coupons case.

Bench of Justices Dinesh Maheshwari and Sanjay Kumar directed that no forceful actions should be taken against Amazon in relation to the CCI's notice issued on April 25 until the next hearing on July 17.

During the hearing, which took place recently, Senior Advocate Gopal Subramanium, representing Amazon, referred to an Interim Application (IA) filed by the company. The IA pertained to the June 2022 ruling by the NCLAT which upheld the penalty of Rs. 200 crore imposed by the CCI and directed Amazon to pay the penalty within 45 days.

In September 2022, Amazon filed a petition in the Supreme Court challenging the NCLAT's decision to reject their plea to challenge the CCI's order of keeping the approval for Amazon's deal with Future Coupons on hold. The e-commerce giant is disputing the NCLAT's ruling and is seeking relief from the Supreme Court.
