The Punjab and Haryana High Court bench of Justices Lisa Gill and Ritu Tagore found no grounds to grant interim relief to 127 petitioners who had filed a plea pertaining to the fact that their house and other structures were being demolished for the development of the Punjab Section of the Delhi-Katra Expressway in the case of Darshan Singh and Ors. V Union of India and Ors. They had contented that no supplementary award has been passed in this case.
The NHAI on the other hand reverted by mentioning that the plea was misleading and did not cater to the original facts. NHAI also produced satellite images to show that only one such house fell within the area of the project, that too only the boundary of the house and not the main house.
They also contented that the supplementary award has been given by the competent authority for this and that the petitioner did not claim anything regarding tube wells or bore wells.
With respect to this, the petitioner mentioned that they did not know about any supplementary compensation and that their issue was pertaining to acquisition of the land and other issues. The Court heard both the parties and did not entertain the plea and kept 10 July as the subsequent date of hearing.
