Arnab Goswami Tenders Unconditional Apology Before Delhi HC

The case was brought by former Executive Vice Chairman of TERI, R.K. Pachauri, accusing Goswami and others of willfully disregarding the court's earlier orders that restricted them from publishing certain claims against him

Arnab Goswami, the Managing Director and Editor-in-chief of Republic TV, has issued an unconditional apology before the Delhi High Court regarding a contempt case from 2016. The case was brought by former Executive Vice Chairman of TERI, R.K. Pachauri, accusing Goswami and others of willfully disregarding the court's earlier orders that restricted them from publishing certain claims against him. At the time of the case filing, Goswami was associated with Times Now.

In an affidavit submitted to the court on April 28, Goswami expressed his apology and requested that the court kindly accept it, resulting in the closure of the ongoing proceedings. The affidavit also emphasised Goswami's adherence to the law, his respect for the courts, and his standing as a law-abiding and respectable citizen of the country.

Goswami clarified that he had no intention to disobey the court's orders and believed that the broadcasts in question did not violate the court's order of February 18, 2015, passed in C.S. (OS) 425 of 2015. He stated that the broadcasts were made in good faith as part of fair reporting, citing the liberty granted under Article 19(1)(a) of the Indian Constitution, as recognized by the court in the aforementioned order.

The response was filed through Advocate Aman Avinav. On April 17, Goswami's counsel, Senior Advocate Malvika Trivedi, informed the court that she would file an affidavit tendering an unconditional apology on behalf of her client within a week. During the proceedings on April 29 before Justice Manmeet Pritam Singh Arora, Trivedi presented a copy of the affidavit to the court.

On the other hand, the counsel representing Raghav Ohri stated that an affidavit tendering an unconditional apology had been filed, without delving into the merits of the allegations, in order to bring an end to the controversy.

Justice Arora was informed that a similar affidavit had also been filed on behalf of The Economic Times. The court scheduled the matter for a hearing on May 22, and although the order of the proceedings has not been published on the court's website yet, the case status indicates that it has been disposed of.

Pachauri, who passed away in 2020, had filed the plea alleging contempt of court against the media houses, as they had violated two court orders that instructed them to adhere to "journalistic norms" when reporting about the inquiry proceedings against him.According to the plea, the media houses were strictly prohibited from publishing any news report, article, or opinion regarding the allegations of sexual harassment against Pachauri. Apart from Goswami, who was the editor-in-chief of Times Now at the time, the plea also named Bennet & Coleman, The Economic Times, Raghav Ohri, and Prannoy Roy as respondents in the case.
