Changes in H1B Visa Regulations - What Can be Expected - Way Forward - What Impact it Could Have on IT Companies.

“The recent change in H1-B visa selection process gives priority to salary and skills of an employee instead of the current lottery system. These new restrictions recently announced by the Trump administration is a considerable blow to Indian IT professionals eyeing the US job market. The restrictions are likely to send shivers across industry verticals and hamper competitiveness from a global perspective. The India-US relations may also see an unnecessary strain on account of these restrictions. According to industry experts, NASSCOM and United States Indian Business Council are expected to request the new administration under Biden to revoke these recent restrictions. Biden is expected to back more flexible policies on H-1B visas mostly because of his public stance on the US to be more open as well as the support he has received from the big American technology companies. However, the specific restrictions imposed on Chinese companies and investments are likely to continue and any general relaxations may not be extended to them.”Gaurav Dayal, Partner, Lakshmikumaran & Sridharan Attorneys.
